This privacy notice explains how Skill Nation B.V. ("Skill Nation", "we", "us" or "our") processes personal data when you use the Overscore mobile application and related services (the "Services"). Skill Nation B.V. is a company established at Tijnmuiden 15, 1046 AK Amsterdam, the Netherlands. We act as the controller for the personal data described in this notice.

We designed Overscore so that you can use the core Services without providing your name or email address. Instead, we use a unique identifier associated with your device to create and maintain your Overscore profile. Nonetheless, some of the information we process is considered personal data under Dutch and European data protection law.

Skill Nation B.V. is a mobile game studio based in Amsterdam, the Netherlands. This notice applies to personal data that we process when you:

This notice does not cover the processing activities of third parties such as advertising networks, app stores or reward partners. Their processing is governed by their own privacy notices. In particular, when you redeem a voucher or other reward with a third party, that partner may process additional personal data about you under its own terms.

2. WHAT DATA WE PROCESS

We aim to keep data collection in Overscore as limited as possible. We do not require you to provide your name, email address or other direct contact details to use the core Services. However, we do process certain categories of personal data.

We do not intentionally process special categories of personal data in Overscore, such as data about health, religion or political opinions.

3. WHY WE PROCESS YOUR DATA AND LEGAL BASES

We process personal data only when we have a valid legal basis under European data protection law, in particular the General Data Protection Regulation (EU) 2016/679 (GDPR) and its implementation in the Netherlands.

3.1 To provide and operate Overscore

We use device and usage data to provide the core functionality of Overscore, including creating and maintaining your profile, saving your progress, running events and challenges and granting in app rewards.

Legal basis: performance of a contract (Article 6(1)(b) GDPR), and where applicable our legitimate interests (Article 6(1)(f) GDPR) in providing and improving our Services.

3.2 To operate reward programs

We process gameplay and reward data, as well as limited data shared with reward partners, to allow eligible users to earn and redeem rewards such as digital vouchers and gift cards.

Legal basis: performance of a contract (Article 6(1)(b) GDPR) and our legitimate interests (Article 6(1)(f) GDPR) in offering promotional reward programs and preventing abuse.

3.3 To show advertising and measure its performance

We and our partners process advertising and analytics data to show you ads in Overscore, to limit how often you see the same ad, to measure the effectiveness of ads and to detect invalid traffic and fraud.

Depending on your location and local requirements, we rely on either your consent (Article 6(1)(a) GDPR) or our legitimate interests (Article 6(1)(f) GDPR) as a legal basis for this processing. Where consent is required, we will ask for it and you can withdraw it at any time via the mechanisms provided.

3.4 To keep Overscore secure and to prevent abuse

We use log, diagnostic and usage data to monitor the stability and security of Overscore, to detect cheating, abuse or fraud and to enforce our terms of use.

Legal basis: our legitimate interests (Article 6(1)(f) GDPR) in securing our Services and preventing misuse, and legal obligations where applicable (Article 6(1)(c) GDPR).

3.5 To respond to your requests and to communicate with you

When you contact us, we process your contact details and the content of your message to respond and keep a record of communications.

Legal basis: performance of a contract or taking steps at your request prior to entering into a contract (Article 6(1)(b) GDPR), and our legitimate interests (Article 6(1)(f) GDPR) in providing customer support.

We may process and retain certain information to comply with legal obligations under Dutch or European law, for example accounting, tax or consumer protection rules.

4. ADVERTISING, ANALYTICS AND REWARD PARTNERS

4.1 Advertising and analytics partners

Overscore uses third party services such as Google advertising services to display ads and perform analytics in the app. These partners may process device identifiers, advertising identifiers, IP addresses and usage information in order to deliver and measure ads.

These partners act as independent controllers or joint controllers in many cases. They use the data for their own purposes in accordance with their privacy notices. You can usually control certain aspects of ad personalisation through your device settings or the consent tools provided.

4.2 Reward partners

When you earn a reward such as a digital voucher through Overscore, we may use a reward partner platform to issue and manage that reward. To do this, we share limited information with the partner, often in the form of a pseudonymous identifier and details of the reward.

If a partner requires direct contact details from you, such as an email address to deliver the voucher, you will provide this information directly to the partner. The partner then acts as an independent controller for that processing and will inform you separately about its data protection practices.

Our servers and many of our service providers are located in the European Economic Area (EEA). However, some partners may process personal data outside the EEA, for example in the United States.

When we transfer personal data to a country outside the EEA that does not have an adequacy decision from the European Commission, we rely on appropriate safeguards such as standard contractual clauses or other mechanisms approved under European data protection law. 7. HOW LONG WE KEEP YOUR DATA

We keep personal data only for as long as necessary for the purposes described in this notice or as required by law.

8. HOW WE PROTECT YOUR DATA

We use appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. These measures include access controls, encryption in transit where feasible and regular monitoring of our systems.

9. YOUR RIGHTS UNDER EUROPEAN DATA PROTECTION LAW

10. CHILDREN AND MINORS

Overscore is intended for users who are at least 13 years old. If you are under 18, you may only use Overscore with the consent and supervision of a parent or legal guardian. Overscore does not require children to provide their real name or contact details to use the core Services.

Only users who are at least 18 years old are eligible for rewards that have real world value, such as digital vouchers or gift cards, as described in our terms of use and end user license agreement.

We do not knowingly collect personal data from children under 13. If you believe that we may have collected personal data from a child under 13 without appropriate consent, please contact us so that we can investigate and take appropriate action.

11. CHANGES TO THIS NOTICE

We may update this privacy notice from time to time to reflect changes in our processing activities or in applicable law. The updated version will be indicated by the "Last updated" date at the top. We encourage you to review this notice regularly. Where required by law, we will inform you of material changes through the app or by other appropriate means.
